If petition is granted, one MDL court would oversee discovery and conduct all pretrial proceedings, including summary judgment on fair use and other issues. 8 turns into 1. Promotes efficiency. OpenAI had been seeking coordinated depositions so its witnesses wouldn’t have multiple depositions each. MDL can also hold a bellwether trial on some claims. - 𝗗𝗼 𝗨𝗻𝘁𝗼 𝗢𝘁𝗵𝗲𝗿𝘀 – 𝗔𝗽𝗽𝗲𝗹𝗹𝗮𝘁𝗲 𝗘𝗱𝗶𝘁𝗶𝗼𝗻The California Bar recently added "Civility" as a required continuing education topic for lawyers. In appellate work as elsewhere, behaving with the maximum courtesy that circumstances allow will advance your client's long-term interests.✅ California appellate courts expect counsel to stipulate to requests for briefing extensions of up to 60 days (the maximum allowed without a court order), unless some urgency requires faster briefing. Making opposing counsel apply to the court for such an extension has no upside; it just adds a step for the court, and makes you less likely to receive the same courtesy when you need it.✅ No appellate brief should ever comment disparagingly on any lawyer or any court. Published opinions condemning such language have become more frequent, and some even impose sanctions. But short of that: disparagement simply hurts your credibility. Leave judgment to the Court of Appeal.✅ At oral argument, little things matter. Don't refer to opposing counsel as "she" with a sideways glance; it sounds dismissive. "Counsel" or "Appellant/Respondent" work well.The lawyer's name is fine ("Ms. Green"), if stated respectfully. Some lawyers even use "my friend," especially in the state or federal supreme court—but if that doesn't feel natural, go with the other options.► 𝗧𝗵𝗲 𝗽𝗿𝗮𝗰𝘁𝗶𝗰𝗮𝗹 𝗺𝗲𝘀𝘀𝗮𝗴𝗲: You know what's coming: do unto others. - The Parkman Law Firm The new California law that went into effect January 1, 2024, now gives trial court judges discretion to stay or continue proceedings when a party appeals from an order denying or dismissing a petition to compel arbitration. Prior to the new law, an appeal would automatically stay trial court proceedings, meaning an appeal of a motion denying a motion to compel arbitration would stop all litigation on the merits of a case while the appeal was pending.The Legislature adopted this new law in response to concern about “meritless appeals that are filed only to delay litigation," this being a common tactic in California trial courts. The new law hinders this by establishing that the denial of a motion to compel arbitration still remains an immediately appealable order, but it will no longer trigger an automatic stay in the Superior Court.However, under Federal law, the Supreme Court recently held that the Federal Arbitration Act (“FAA”) requires a district court to stay its proceedings while an appeal concerning arbitration is pending. The new California procedure now differs from federal law under the FAA. It is yet to be determined which procedure will control in a proceeding in California state court where the arbitration agreement is subject to the FAA. The FAA can, at times, preempt state laws that restrict the right to arbitrate. A party that loses a motion to compel arbitration in state court on an agreement stating the FAA applies and is denied a stay of proceedings may thus argue that California may not undermine the FAA by denying a stay while the appeal is pending.We will continue to update you on this new law and its effect on California legislation. - 𝗪𝗵𝘆 𝗛𝗲𝗮𝗱𝗶𝗻𝗴𝘀 𝗠𝗮𝘁𝘁𝗲𝗿 𝗶𝗻 𝗔𝗽𝗽𝗲𝗹𝗹𝗮𝘁𝗲 𝗕𝗿𝗶𝗲𝗳𝘀Under California appellate rules, briefs must state each point under a separate heading or subheading. Appellants and respondents alike should heed this requirement, as both persuasion and preservation may depend on it. Some practice tips to consider:✅ Many appellate courts will deem an argument forfeited if buried under an unrelated heading, or made only in a footnote.✅ Headings should be substantive, but not so lengthy that they cease to serve as "headlines" and start to resemble text.✅ Organizing headings for each distinct contention brings discipline to the drafting process, making the brief more coherent and digestible. Generating a new Table of Contents for each draft is an excellent editing tool, helping you see whether points flow logically and persuasively.✅ If the Table of Contents has "gaps" that would confuse a stranger, revise. Justices often read the TOC to gain a substantive overview of the brief before diving in.► 𝗧𝗵𝗲 𝗽𝗿𝗮𝗰𝘁𝗶𝗰𝗮𝗹 𝗺𝗲𝘀𝘀𝗮𝗴𝗲: Ensure that your brief headings are crisp and clear, and that they smoothly outline all your core contentions on appeal.#appealsLaurie Hepler 10

While you should still do everything you can to get a traditional court reporter whenever possible, the Los Angeles Superior Court announced today the issuance of a general order authorizing LASC judges to order electronic transcription of court proceedings where there is no court-employed court reporter available, and the court makes one or more findings specified in the general order. The electronic reporting procedure is available when requested by the judicial officer presiding over the proceeding and when a court reporter is not available, to operate electronic recording equipment in certain family law, probate and civil proceedings.The order applies only when the Court is unable to provide an official court-employed court reporter due to an ongoing and well-documented court reporter shortage, when a litigant is unable to secure the services of a private sector court reporter at the litigant’s expense, and when the judicial officer makes specific findings that fundamental constitutional rights are at stake.
